Am I an Employee or an Independent Subcontractor when I do jobs through PetCloud?

When you become a Pet Carer through PetCloud, you are a Subcontractor, not an Employee of PetCloud.
This is determined because:
  1. You are responsible for determining your own prices on your Sitter Listing
  2. You choose the types of jobs and pets you want by Accepting or Declining.
  3. The Start Time, Duration, and the Frequency of those jobs are determined by You in negotiation with Pet Owners and are not determined by PetCloud.
  4. You are responsible for your own ABN registration, your own Superannuation Contributions, Lodgement of Annual Tax Returns, and Quarterly BAS Statement (if these are applicable to you) & seeking financial advice from an Accountant.
  5. Pet Owners supply subcontractors with the necessary tools and equipment for carrying out the jobs. Sitters should request them.
  6. PetCloud has no control over how the work is performed since all jobs are performed remotely.  We help to train you to help you understand the standard of care the RSPCA advocates for.
  7. The jobs on PetCloud are of an adhoc nature.
  8. With regard to risk - we choose to have a policy that covers Pet Accidents in the event of negligence by subcontractor Pet Sitters.
  9. If you share a Sitter Listing with a colleague, family member, or friend, and they are police checked and trained, then you are able to delegate jobs to them with permission from the Pet Owner. You may not delegate jobs without the permission of the Pet Owner and if that person is not trained and police checked through PetCloud.
  10. When you're performing jobs, you wear your own clothes and you don't wear a PetCloud uniform.
  11. You are free to offer pet care services through several different apps.
  12. As an independent subcontractor, you aren't entitled to sick leave. This is because independent contractors aren’t covered by the National Employment Standards.  You may wish to look into Income Protection Insurance so that in the event you're unable to work due to sickness or injury, you'll be provided temporary payments to be able to maintain your lifestyle.
